Terms of Service
These terms are an agreement between you and Nikhil Suresh, an independent developer based in Ireland ("we", "us"), for your use of Super Cricket 3 (the "Game"). By downloading or playing the Game you accept them. If you don't accept them, please don't play. The Privacy Policy explains how we handle your data.
If you're under 18, a parent or guardian should read these terms with you and agree to them for you.
1. Your licence to play
We give you a personal, non-exclusive, non-transferable, revocable licence to download and play the Game for your own non-commercial entertainment, on devices you own or control, under these terms and the rules of the app store you got it from. The Game, including its code, art, music, characters and content, belongs to us or our licensors, and we keep all rights not expressly given to you. Team, player and competition names in the Game are used for a cricket game experience and don't imply endorsement by any real league, team or player.
2. Your account
An account is created for you automatically when you first play. You're responsible for activity on your account and on the devices and Google Play Games account linked to it. Keep your device secure. You can delete your account at any time in Settings, or online.
3. Virtual currency and items
- Coins, gems, packs, players, items and other virtual content in the Game ("Virtual Items") are part of your licence to play. They aren't your property, have no cash value, and can't be sold, traded, transferred or exchanged for money or anything outside the Game.
- Virtual Items bought with real money are delivered when the app store confirms payment. We may change, rebalance or remove Virtual Items and how they work as part of running and improving the Game.
- Virtual Items are lost if your account is deleted or terminated, or if the Game is discontinued, except where the law gives you a right to a refund.
4. Purchases and refunds
Purchases are made through Google Play or the Apple App Store, under their terms and refund policies, and refund requests go to them. Because Virtual Items are digital content delivered immediately, you agree they start straight away and, as far as the law allows, you lose any right to cancel once they're delivered. Nothing in these terms affects your statutory rights as a consumer. If a purchase doesn't arrive, contact us and we'll put it right.
5. Fair play
You agree not to:
- cheat, or use hacks, bots, modified clients, emulators to gain an advantage, or exploits;
- tamper with the device clock, saves or network traffic to gain an advantage;
- reverse engineer, decompile or modify the Game, except as the law expressly allows;
- use offensive, impersonating or unlawful team or display names, or harass other players;
- buy, sell or trade accounts or Virtual Items outside the Game;
- disrupt the Game, its servers or other players' enjoyment of it.
If we reasonably believe you've broken these rules, we may reset or remove progress or Virtual Items gained unfairly, change your name, or suspend or close your account, without refund where the law allows. Where we can, we'll tell you why.
6. Online features and availability
Some features need an internet connection and our game server, and data charges may apply. We work hard to keep the Game running and your progress safe, but we can't promise it will always be available, uninterrupted or error-free, or that saves will never be lost. We may update, change, suspend or stop the Game or any feature. If we decide to shut the Game down, we'll give reasonable notice in the Game or the store listing.
We may release updates you need to install to keep playing, and we may reset game progress as part of a major change to the Game (for example moving from early access to a full release). Where we reset progress, we'll tell you beforehand where we reasonably can.
7. Feedback
If you send us ideas or feedback, we may use them freely to improve the Game without paying you or crediting you.
8. Ads and third-party services
The Game shows ads and uses services from other companies, such as Google, Apple, Microsoft PlayFab, Unity and AppLovin. We're not responsible for their content, products or services, and your use of them may be covered by their own terms.
9. The Game is provided "as is"
As far as the law allows, the Game is provided "as is" and "as available", without warranties of any kind beyond those the law requires us to give. This doesn't affect your statutory rights. Consumer law where you live, such as the EU and Irish rules on digital content, UK consumer law or the Australian Consumer Law, gives you guarantees that the Game will be of acceptable quality and as described, and these terms don't take them away.
10. Our liability
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else that can't be limited or excluded by law.
Otherwise, and as far as the law allows: we're not responsible for loss or damage that wasn't foreseeable, for business losses (the Game is for personal use only), or for loss of Virtual Items or game progress beyond what the law requires; and our total liability to you for all claims relating to the Game is limited to the amount you paid us for the Game and Virtual Items in the 12 months before the claim arose, or €50 if that's higher.
If you're a consumer, you have legal rights in relation to digital content that's faulty or not as described, and these terms don't take them away. In Australia, our liability for failing to meet a consumer guarantee is limited, where the law allows, to supplying the Virtual Items again or paying the cost of having them supplied again.
11. Ending these terms
You can stop playing and delete your account at any time. We may suspend or end your access if you seriously or repeatedly break these terms, if the law requires it, or if we discontinue the Game. Sections 3, 7, 9, 10 and 13 continue after these terms end.
12. Changes to these terms
We may update these terms, for example to reflect changes to the Game or the law. The date at the top shows the latest version. For significant changes we'll tell you in the Game or the store listing, and continuing to play after a change means you accept it. If you don't, stop playing and delete your account.
13. General
These terms are governed by the laws of Ireland, and the courts of Ireland have jurisdiction. If you're a consumer living elsewhere, you keep the protection of the mandatory consumer law where you live and can bring a claim in your local courts. If any part of these terms is found unenforceable, the rest still applies. If we don't enforce a term straight away, we can still enforce it later. You may not transfer your rights under these terms; we may transfer ours to someone who takes over the Game, without reducing your rights.
The app store you downloaded the Game from isn't a party to these terms and isn't responsible for the Game or for supporting it. If you got the Game from the Apple App Store, Apple and its subsidiaries are third-party beneficiaries of these terms and can enforce them against you.
